which of these 2 tanks has better penetration and dmg vs axis amour, i know the m10 does more dmg per shot, but against the heavier axis tanks, panther/tiger which is more likely to score a damaging shot from the front/side?

According to this convenient thread which I don't know how I remember (http://forums.relicnews.com/showthread.php?t=209848) about M10's, and CoH-Stats.com (http://www.coh-stats.com/factions/american/units/m10tankdestroyer.html), M10's are better than upgunned Shermans.
In fact, Shermans still remain relatively weak against tanks compared to M10's.

Of course, although fast, M10s are thin skinned and lack anti infantry capability. Aside from squishing them. Very easy for Germans to kill. and MUST have infantry support.

Please see attached screenshot* showing accuracy, damage and penetration for an M10, Sherman and Upgunned Sherman vs various Wehr tanks.
It looks like the M10 is far superior (in terms of damage etc) than the Sherman, even upgunned. So, M10 is the answer.

the gun goes through the animation of firing, but it doesn't acctually fire for some reason. this however isn't counted against the unit and it doesn't reset any timers, it is just an asthetic glitch which happens because of the M-10s high speed and turret traverse some times being unable to keep up with tracking targets.
although it will happen with most all tanks which will stop firing when they lose a target, even though the animation of the gun firing happens, it is more apparent with the M-10 as it will often 'Burp' several times before firing.
on paper the M-10 sounds like a good idea.
however, in practice when everything comes togeather, you'll often find that getting a Sherman with Upgun is the better investment. the M-10s paper thin armor and piss poor health often leads to it being killed long before it has any decent damage output. although Shermans don't quiet have the DPS, they have the survivability to acctually dish out some damage, unlike the M-10.
but go test it yourself.
ideally, you want to have just 1 M-10 for every 2-3 shermans. while the shermans spounge up the damage from the tank in a straight forward engagement, the M-10 glides around the flank and deals massive damage in the form of flanking shots.
that is the M-10s true purpouse, and using it as your primary head to head tank killer (which many try to use it for) will find that it will fail completely in that role.
