If a unit capable of joining another unit. Such as any commander, an apothecary, or a mad doc are currently in melee and join a nearby unit while still engaged in melee that unit will not realize it is in melee. The result is it will ignore the melee and act as it normally would.

For example two force commanders are fighting. Yours is lower in hp by a bit so you command him to join a nearby unit (he doesn't have to move to join it.) Instead of the nearby unit joining the fight in progress they just keep shooting as if nothing happened. Additionally the Force Commander that joined the unit doesn't count as he is in melee anymore (even though he is fighting using his melee attack.) The result is that force commander will definately get stunned by the other force commander and the only way to get the unit to behave properly is manually issue a melee order (and sometimes you have to remove the force commander from the unit as they will resist a manual melee if he gets stunned by an enemy force commander.) Obviously this littel quirk in the AI is an easy way to lose a ton of HP on your commander when fighting against a force commander.

This is primarily an issue when you fight with shooting troops (who are in ranged stance.) Something in versitile stance or melee stance will normally engage itself in melee pretty quickly.
